Purpose of the form

The sole purpose of this form is to report breaches of the Digital Services Act. It is intended to enable you to report potential cybercrime, data breaches and other security-related incidents.

 

Confidentiality

Your report will be treated confidentially. Your personal data will be processed in accordance with the applicable data protection regulations and will not be passed on to third parties without your consent, unless this is required by law.

 

Central reporting office

We have set up a central reporting office that you can contact at any time if you need assistance in reporting an incident or have questions about your concern. The contact details of our central reporting office can be found below.

 

Correctness of the information

You are obliged to provide truthful and complete information. Incorrect information may have legal consequences.

 

Use of your data

The data entered in the form will be used exclusively for the purpose of investigating and processing your report. Your data will be stored securely and only kept for as long as is necessary to process your report.

 

Exclusion of liability

We accept no liability for any direct or indirect damage that may arise from the use of this reporting form. Use of the form is at your own risk.

 

Legal basis

Notification details

You must provide us with the following information:

  • A reasoned explanation of why you consider the reported content to be unlawful or in violation of our Terms of Use
  • A clear indication of the exact electronic location of the content, such as the precise URL address(es) or, where necessary, other relevant information to identify the unlawful content.
  • Your name and email address, unless the information is deemed to relate to a criminal offense referred to in Articles 3 to 7 of Directive 2011/93/EU
  • A statement that you have a good faith belief that the information and statements contained in the notification are accurate and complete

Terms of use of the website

Clause 1: Obligations when using the website

When using the website, you may communicate with other users of the website in various ways. In doing so, you are obliged to comply with applicable law and not to violate the rights of third parties (e.g. copyrights and personal rights) and to behave objectively, politely and respectfully towards third parties and their views and customs in dialog. For you, this means in particular

  • not expressing yourself in an offensive or otherwise disparaging manner towards others
  • not behaving in a way that may damage the reputation of others, e.g. mentioning the names of others or disclosing personal details about third parties;not expressing oneself in an anti-constitutional, illegal, racist, sexist, discriminatory, anti-religious, or violence-glorifying or similar manner
  • not threatening others
  • not to post any content if there are copyrights or ancillary copyrights or other intellectual property rights to this content in favor of third parties and the entitled parties have not declared their consent to the specific use;not to post any texts, videos or photographs that make third parties recognizable if these persons have not declared their consent to this
  • plan or carry out illegal, fraudulent or manipulative activities.

The netiquette must also be observed.

 

Clause 2: The mechanisms for reporting illegal content

Any user can submit a report from the website to report content that is considered illegal or violates the terms and conditions of the service. Users will be provided with a button to report content. Users should ensure that their report is as complete as possible. The reports will then be reviewed by the company without delay. By using this procedure, users undertake to submit reports in good faith and not to abuse the reporting or complaint procedure by making unfounded reports or calls. Abuse may be punished. init[ reserves the right to take measures to restrict or prevent the processing of reports and to block or delete accounts of persons who abuse the reporting or complaint mechanisms, in particular by submitting unfounded reports.

 

Section 3: Measures and decisions on content moderation include:

A review of reports/complaints received from users regarding unlawful content received via the internal complaint handling system available to users and advertisers of the website, or which have come to the attention of content moderation through internal review, shall take place. If the moderating department becomes aware of a violation of the GTC or the dissemination of illegal content, the following measures and decisions may be taken:

a) Access blocking

init[ is entitled to block your access to the website temporarily or permanently if there are concrete indications that you are in breach of your obligations under these terms and conditions of use, in particular the obligations under Section 1. In this case, ]init[ will notify you of the blocking by e-mail. The same applies to the lifting of the block. The option of extraordinary termination of the user relationship remains unaffected.

b) Blocking/deleting content

init[ is entitled to remove individual comments posted by you on the website or to temporarily or permanently block users' access to them if there are concrete indications that this content violates applicable law or the rights of third parties or the other obligations under Section 1.

c) Discretion of the moderation

The moderating department decides on the basis of the risk and severity of the infringement whether the content and/or the account must be restricted. It may restrict or remove content or accounts after a single serious violation of the above rules if it is determined that illegal content has been repeatedly posted by a user account or several obviously unfounded reports or complaints have been submitted.

 

Section 4: Appeals against the decision of the moderator

4.1 Internal system for handling complaints

Users may challenge the decision made by the company in response to the report within a period of six months after receiving notification of the decision by replying directly to the notification email. These challenges will be forwarded to the moderating department, which will re-examine the content to confirm the decision.

4.2 Out-of-court settlement of disputes

Users may also choose to challenge the company's moderation decision by submitting the dispute either to an out-of-court dispute resolution body certified under the Digital Services Ordinance (DSA) or to a competent court.
